Trespass Policy

PURPOSE

To give the Principal the authority to enforce the “Summary Offences Act 1966”, in order to deal with trespassers on the School premises.

 

BROAD GUIDELINES

 

1.    The Principal should have the authority to:

     1.1 Issue formal warnings to persons not to enter the school premises

1.2 Erect signs prohibiting trespassers

1.3 Order persons and trespassers off school property

1.4 Authorise others to exercise the new powers on behalf of the Principal.

 

2.   The Principal should have the authority to give warnings to persons not authorised to enter the school by:

2.1 Warning the person or trespasser to leave the school premises (refer 3.0 of   

  Trespassers Guidelines.  Executive Memorandum No. 97/041)

2.2 Warn a person not to enter the school premises (refer to 4.0)

2.3 Erect signs warning persons not to enter the school premises (refer to 6.0)

2.2 Request the police to lay a charge under section 9 of the Summary Offences    

           Act 1966, when a person fails to comply with an above warning. (refer to 5.2).

 

3.   The School should encourage community use of school facilities where persons do not pose a threat to members of the school community or damage to school property.

 

4.   The Principal should have the authority to request that police charge the person with trespass for more serious or persistent instances.

 

5.   All staff should need to know and understand the procedures to be undertaken when a person trespasses or a warned trespasser returns to the school premises, contrary to a warning.

 

6.   The Principal should authorise selected staff or a School Council member to exercise the principal powers as occupier as deemed necessary.

 

7.   The Principal should only delegate their powers in writing to those people who have knowledge, understanding and capacity to use the powers consistently and appropriately. (refer to attachment 4)

 

8.   The Principal should ascertain whether the person has a legitimate purpose or lawful excuse to be on school premises before any warnings are given.

 

9.   The Principal should not remove or use force against a trespasser unless the circumstances are extreme.  If needed the police should be called.

 

10. The School should display prominent warning signs in the school grounds.

 

IMPLEMENTATION

 

1.    Signs will be erected where necessary.

 

2.    Staff will need to be familiar with attachments 1-6.

 

3.    The Principal will use the appropriate form when authorising other  people to exercise their authority as occupier.  (See attachment 4)

 

4.    The Principal will give warnings:

4.1 Orally

4.2 By handing to the person a written notice setting out the warning (see attachment 5) or

4.3 By sending a written notice setting out the warning by certified mail addressed to the person at their usual address (see 4.1-4.4 of the Trespass Guidelines).

 

5.   The School will encourage community use of school facilities.

 

6.   The Principal will call police in circumstances where a trespasser needs to be removed.

 

7.   The Principal will use the appropriate forms for recording the warning given. (see attachment 6)
